Application by Woyome is a red herring and is an attempt to delay proceedings in the matter – Supreme Court rules

A three-member review panel of the Supreme Court presided over by Justice William Atuguba has dismissed an application by Mr. Alfred Agbesi Woyome who is seeking the court to reverse orders made by  Justice Ampah Benin.

The panel including Justices Sophia Adinyira and Jones Dotse concluded that the application filed by Mr. Woyome, is a red herring that the learned counsel of the Applicant introduced as a further illustration of their attempt to delay proceedings in the matter. The application was consequently dismissed.

The Court has also ordered the oral examination of the Applicant to continue.

Justice Benin who is solely presiding over the oral examination of the judgment debtor and Applicant ordered the sale of his properties and also invited the Lands Commission to testify on the state of Woyome’s properties.

In his application, Counsel for the Applicant, Yaw Osafo Buabeng said the order of the sole judge violates the orders of Order 46(1) of the High Court (Civil Procedure) Rules, 2004 (C.I. 47) which does not allow the judge to make such orders.

Counsel also said that orders of the sole judge, Justice Benin, was an infringement on Mr. Woyome’s right to privacy.
