Court acquits and discharges painter accused of indecent assault

An Accra Circuit Court presided over by Her Honour, Abena Oppong Adjin Doku, has acquitted and discharged one Emmanuel Nathaniel, who was accused of brushing the vagina of a 6-year old with his penis.

The Court held the view that the Prosecution was unable to prove beyond reasonable doubt that the offence was committed by the Accused.

The Court also held the view that there were inconsistencies in the statement of the Victim.

The facts of the case are that, the Complainant, Linda Ayeh, is the mother of the Victim, aged 6 years and lives with the victim at Pambross.

The Accused person Emmanuel Nathaniel, aged 23 years, a painter, also lives in the same vicinity with the Complainant.

On 25th February, 2017, the Complainant left the Victim in the care of a neighbour by name Vida and travelled to her hometown, Aburi.

The Complainant on return from Aburi on 12th March, 2017, was informed by the Victim that when she went to attend to nature’s call in her absence, she met the Accused and he lured her into his room, removed her pant, laid her on the floor and brushed her vagina with his penis.

Upon receipt of the information, a report was made to the Dansoman Police and a police medical form was issued to the Complainant to send the Victim to a hospital for medical examination and report.
